Terms of Service

Last updated: October 23, 2026

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you ("Customer", "you") and Winter Storm Systems ("we", "us", "our") governing your use of our website, billing platform, and hosting services, including VPS hosting, shared web hosting, game and bot hosting, and dedicated servers (collectively, the "Services"). By creating an account, placing an order, or using any Service, you accept these Terms. If you do not agree, do not use the Services.

2. Accounts

You must provide accurate, current information when registering and keep it up to date. You are responsible for all activity under your account and for keeping your credentials secure — we strongly recommend enabling two-factor authentication in your profile. You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase Services. One person or entity may not maintain multiple accounts to evade limits, promotions, or enforcement actions.

3. Services & Provisioning

Service specifications (resources, locations, features) are described on the relevant product pages at the time of order. Services are typically provisioned automatically after payment is confirmed; some orders are subject to a brief manual review. We may decline or reverse any order at our discretion, in which case amounts paid for the declined order will be refunded.

Resources are provided for your reasonable use of the plan you purchased. On shared platforms, sustained resource consumption that degrades service for other customers may result in a request to reduce usage, upgrade to a more appropriate plan, throttling, or suspension.

Where a shared hosting plan advertises a resource as 'unlimited' or 'unmetered,' this means that the plan does not have a fixed advertised usage allowance for that resource. It does not mean that server resources are infinite or that the service may be used for any purpose without restriction.

Unlimited or unmetered shared hosting resources are intended for normal website, email, database, and application hosting associated with active websites hosted on the account. Shared hosting may not be used primarily as a backup repository, file storage service, cloud drive, media archive, file-sharing platform, or other bulk storage service unrelated to the websites or applications hosted on the account.

We may review accounts whose use of storage, bandwidth, CPU, memory, disk I/O, email, databases, or other shared resources is unusually high or negatively affects the stability or performance of the server or other customers. Where reasonably possible, we will contact the Customer and provide an opportunity to reduce usage or move to a more appropriate service before restrictions are applied.

4. Billing, Renewals & Late Payment

Services are billed in advance on the cycle selected at checkout. Renewal invoices are generated automatically before the due date and payment is due by the date shown on the invoice. Configurable options and add-ons selected at order time are part of the recurring price. Prices may change with notice effective from your next renewal.

If an invoice remains unpaid past its due date, we send reminders and may suspend the associated service. Services left unpaid after suspension may be terminated and their data permanently deleted. It is your responsibility to keep a valid payment method on file and to pay invoices on time.

Account credit, where present, may be applied to invoices from the client area. Credit has no cash value, is non-transferable, and is not redeemable for withdrawal unless required by law.

5. Plan Changes

You may upgrade or downgrade eligible services from the client area. Upgrades take effect immediately and are invoiced pro-rata for the remainder of the current billing cycle. Downgrades take effect immediately with the lower rate applying from the next renewal; no refund or credit is issued for the current cycle.

6. Refunds & Cancellations

You may request cancellation of any service from the client area at any time; cancellation stops future renewals. Unless expressly stated on a product page, fees already paid are non-refundable, including partial billing periods. Setup fees, domain registrations, and license fees are always non-refundable. Chargebacks or payment disputes filed without first contacting support may result in immediate suspension of all services on the account.

7. Acceptable Use

You agree not to use the Services to:

  • violate any law, or infringe the rights of any third party;
  • send unsolicited bulk email (spam) or operate open relays/proxies;
  • host, distribute, or link to malware, phishing pages, or stolen data;
  • launch, participate in, or control denial-of-service attacks, port scanning, brute forcing, or other attacks on networks or systems;
  • mine cryptocurrency on shared or game/bot hosting plans unless the product page expressly allows it;
  • host content that is illegal in your jurisdiction or ours, including child sexual abuse material (reported to authorities without notice);
  • resell Services without our written consent where the product page does not grant resale rights.

We may suspend or terminate services that violate this policy. Where practical we will notify you and give you an opportunity to remedy the issue; for severe abuse (attacks, malware, illegal content) we may act immediately and without notice.

8. Your Data & Backups

You are responsible for your own backups. While we operate infrastructure-level backups for disaster recovery, these are not guaranteed and are not a substitute for your own offsite copies of your data. Upon termination of a service, for any reason, associated data is deleted and may be unrecoverable.

9. Service Availability

We target high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced where reasonably possible. Our uptime commitment for eligible hosting services, the downtime it excludes, and its exclusive remedy (service credit) are set out in our Service Level Agreement, which forms part of these Terms. Where a product page states a different uptime commitment for that product, the product page applies to it.

10. Suspension & Termination

We may suspend or terminate Services for non-payment, violation of these Terms, risk to the platform or other customers, or where required by law. You may terminate at any time via cancellation in the client area. Sections that by their nature survive termination (payment obligations, liability limits, indemnity) survive.

11. Disclaimers & Limitation of Liability

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill; and (b) our total aggregate liability arising out of or relating to the Services is limited to the amount you paid us for the affected service in the three (3) months preceding the event giving rise to the claim.

12. Indemnity

You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on our website or by email. Continued use of the Services after changes take effect constitutes acceptance. The "Last updated" date above reflects the current version.

14. Contact
